1. Introduction
Welcome to Oahe Landscapes LLC. These Terms and Conditions govern the services provided by our landscaping company. By using our services, you agree to comply with and be bound by these terms.
2. Services
We offer various landscaping services, including but not limited to:
- Garden design
- Irrigation installation
- Irrigation repair
- Hardscaping
- Softscaping
- Water features
- Landscape maintenance
Service details, costs, and timelines will be outlined in individual contracts or written agreements.
3. Estimates and Payments
- Estimates under $10,000 are free.
- Estimates exceeding $10,000 may incur a design fee, at the company’s discretion.
- A deposit of 25% or more may be required before work begins.
- Irrigation service repairs are subject to a 1-hour minimum charge.
- Progress payments may be required depending on project scope.
- Payment is due upon completion unless otherwise agreed to in writing.
- Late payments may incur a 1.5% fee per month.
- A 3% credit card processing fee may be applied.
4. Cancellations and Rescheduling
- Cancellations must be made at least 30 days before the scheduled service date.
- Rescheduling is subject to availability and may result in additional charges.
- Deposits may be non-refundable if cancellation occurs after a specified period.
5. Client Responsibilities
Clients agree to:
- Ensure access to the property on the scheduled service date.
- Remove personal belongings, pets, and obstructions that may interfere with work.
- Provide accurate information regarding property conditions that may affect service execution.
6. Liability and Warranty
- We strive to provide quality services but are not responsible for damages resulting from pre-existing conditions or unforeseen circumstances.
- A limited warranty may be provided for specific services, as outlined in the service agreement.
- We are not liable for damage caused by natural events, third parties, or client negligence.
7. Safety and Compliance
- We comply with all applicable local laws and safety regulations.
- Clients must disclose any known underground utilities or hazards.
- We reserve the right to refuse or stop work if conditions are deemed unsafe.
8. Termination of Services
- Oahe Landscapes LLC reserves the right to terminate services for non-payment, unsafe conditions, or failure to comply with these terms.
- Clients may terminate services with proper notice as defined in their service agreement.
9. Dispute Resolution
- Any disputes should first be addressed through direct communication.
- If unresolved, disputes may be resolved through mediation or legal action in accordance with local jurisdiction.
10. Seeding Germination Disclaimer
Oahe Landscapes LLC is not responsible or liable for hydroseed that fails to germinate or establish due to circumstances beyond our control. These include, but are not limited to:
- Weather conditions or acts of nature
- Customer negligence
- Insufficient or irregular watering
- Lack of a functioning sprinkler or irrigation system
- Site preparation or grading not performed by Oahe Landscapes LLC
Once installation is complete, the customer assumes full responsibility for all watering, maintenance, and aftercare required for proper growth and establishment.
Any touch-up work, re-seeding, or additional service visits required due to these circumstances will be billed to the customer.
11. Change Orders
Definition: A Change Order is any modification to the original scope of work, including changes in materials, design, or schedule.
- Request & Approval: All changes must be submitted in writing and approved by both parties before work begins.
- Cost Adjustments: Approved changes will incur additional costs. A written estimate may be provided prior to proceeding.
- Timing & Delays: Changes may affect project timelines. Updated schedules will be provided if necessary.
- Payment: Payment for change orders is due upon completion unless otherwise agreed.
- Limitations: Major changes may require a formal contract amendment.
12. Material Price Changes
If material costs rise unexpectedly, Oahe Landscapes Hills Division LLC reserves the right to adjust the contract price. Any such changes will be communicated to the client before work continues.
13. Changes to These Terms
We reserve the right to modify these Terms and Conditions at any time. Updates will be posted on our website or communicated directly to clients.
